How to Enter: Beginning at 9:00 a.m. Eastern Time ("ET") on July 15, 2008 until 5:00 p.m. ET on October 31, 2008, you may enter the Farm Rich "Family Fun Trek: Hawaii" Sweepstakes (the "Sweepstakes") by visiting www.farmrichfun.com ("the website"), completing the entry form in its entirety, and submit the entry in accordance with the on-screen instructions. Limit one (1) entry per eligible person, per valid email address, per day. All entries must be received by 5:00 p.m. ET on October 31, 2008 to be eligible.
Eligibility: This Sweepstakes is open only to legal residents of the U.S. and its territories, possessions, and commonwealths (excluding Puerto Rico) who are 18 years of age or older, except employees and members of their households, whether or not related and immediate families (spouses, parents, siblings, children and each of their respective spouses, regardless of where they reside) of the Sweepstakes Entities (as defined below) and their respective parent companies, subsidiaries, and affiliates, and their advertising and promotion agencies and all local sponsors.
Limitations of Liability: Rich Products Corporation ("Sponsor"), their respective affiliates, subsidiaries, parent corporations, advertising and promotion agencies, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively with Sponsor, "Sweepstakes Entities"), are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; inability to access www.farmrichfun.com; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, or any combination thereof. Online submission is not considered proof of delivery or receipt. All entries become the property of Sponsor and will not be returned. By entering, all participants and/or entrants agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and their respective parent companies, subsidiaries, their respective representatives and agents, advertising and promotion agencies, sweepstakes partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages or liability arising in connection with each entrant's participation and/or entry in the Sweepstakes and/or their receipt or use of any prize awarded in this Sweepstakes or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any sweepstakes-related activity or participation in this Sweepstakes. Any and all warranties and guarantees are subject to the respective manufacturer's terms.
How Winners will be Determined: The potential prize winners will be selected by an Independent Administrator on or about November 10, 2008 in a random drawing from among all eligible entries received. The potential Grand Prize winner will be contacted by phone on or about November 15, 2008. The potential First Prize winners will be notified by phone, email, and/or US mail within two (2) weeks of the drawing. Sponsor's decisions with respect to the prize winners and other matters pertaining to the Sweepstakes shall be final and binding. The potential Grand Prize winner will be required to sign an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within ten (10) days of date of issuance of prize notification. If Sponsor is unable to contact any potential prize winner within ten (10) days from date of first notification attempt, or if the potential prize winner (i) fails to complete and return all requested forms by the specified date, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, his/her prize will be forfeited and, at Sponsor's discretion, an alternate winner may be selected.
By entering into the Sweepstakes, all entrants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, notification or permission, except where prohibited by law. The odds of winning depend upon the number of eligible entries received for the applicable drawing.
Conditions of Entry: This Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws and regulations. Void in Puerto Rico, outside the U.S. and where prohibited by law. Entry materials that have been tampered with or altered are void. If, in the sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Sponsor reserves the right at their sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on farmrichfun.com. In the event of a dispute as to the identity of the winner based on an e-mail address, the winning entry will be determined by the authorized account holder of the e-mail address submitted at time of entry and he/she must comply with these Official Rules. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Prizes: One (1) Grand Prize Winner ("Grand Prize Winner") will receive a trip to Hawaii for four (4) people consisting of the following: (i) roundtrip coach airfare to Honolulu, HI from the major airport closest to winner's home address; (ii) Inter island flights to The Big Island, Maui, and returning to Oahu; (iii) first class hotel accommodations (1 room, quad occupancy; room rate and tax only) in Oahu for four (4) days/three (3) nights, on the Big Island of Hawaii for three (3) days/two (2) nights, and in Maui for three (3) days/two (2) nights; (iv) rental car for duration of trip; (v) hike Diamond Head in Oahu; (vi) Tour the USS Bowfin Submarine Museum and Park; and (vii) visit Hawaii Volcanoes National Park and the Panaewa Zoo on The Big Island. Approximate Retail Value (ARV) of this Prize Package is $10,000.
Fifty (50) First Prize Winners (collectively with Grand Prize winner, "Winners") will each receive a $100 American Express Gift Card. Total ARV of all First Prizes: $5,000.
Total ARV of all fifty-one (51) prizes being offered in the Sweepstakes: $15,000.
The specifics of all aforementioned elements of the Grand Prize in the Sweepstakes shall be solely determined by Sponsor. All costs, taxes, fees, and expenses (including, but not limited to meals, beverages, incidentals, tips, or other personal expenses) associated with acceptance and use of any element of any prize not specifically addressed above as being awarded are the sole responsibility of the prize winner. Rental car (model and type) is subject to availability and rental provider's terms and conditions. Prize winner and their respective guests must travel on the exact same itinerary (the same airline and flight) or prize may be forfeited and awarded to an alternate winner. Dates for taking the trip may be selected at the discretion of the winner, but are subject to availability and other blackout dates as dictated by the airline and hotel. All travel must be completed by October 31, 2009, or the prize may be forfeited and an alternate winner selected.
Travel companions of prize winner must be aged 18 years or older, or if a minor, have the written permission of parent/legal guardian, and will be required to sign publicity and liability releases, and return same, properly executed, prior to issuance of travel documents. All travel must be arranged with Sweepstakes Administrator a minimum of forty-five (45) days in advance, and is subject to availability. If prize winner is unable to fulfill the prize during the specified time period, such prize winner forfeits the prize and an alternate winner may be selected. Once travel arrangements have been made and tickets have been purchased, travel may only be altered at the sole expense of the winner. All federal, state and local taxes on prizes are the prize winner's responsibility. Grand Prize winner will be issued a 1099 tax form for the ARV of the prize (Approximately $10,000.00). Some restrictions may apply. The prizes cannot be transferred or substituted except at Sponsor's sole discretion. Sponsor reserves the right to substitute the prize, or portions thereof, with a prize of equal or greater value. All prizes will be awarded.
Winner's List: Beginning on or about December 15, 2008, you may obtain the name of the prize winner by going to www.farmrichfun.com. Results of the drawing will be removed from www.farmrichfun.com on or about January 15, 2009.
